SEC "Gagarinsky" lost the name

The daughter of the first cosmonaut, Elena Gagarina, achieved the deprivation of the name of the Gagarinsky shopping and entertainment center. Recall that the controversial brand was registered in 2011 by Rospatent at the request of Gagarinsky SEC LLC, which manages the shopping center of the same name in Moscow. Elena Gagarina filed an objection with the department, referring to the fact that designations identical to the name, pseudonym or designation of a person known in Russia, which is derived from them, cannot be registered as trademarks, without the consent of this person or his heir.

Rospatent dismissed Gagarina's objections, after which Elena filed a lawsuit. The first instance of the Intellectual Property Rights Court (SIP) in October satisfied the claim, relying on the conclusions of the expert examination, which was designed to find out how consumers perceive the verbal element "Gagarinsky" in the name of the shopping center. The Presidium (SIP) upheld the decision of the first instance of the court on the claim of the daughter of the first cosmonaut Elena Gagarina.

Thus, the court recognized the validity of the objections of Elena Gagarina and the invalidity of the decision of Rospatent.
