As part of the property sale procedure, which was introduced against the founder of Carlo Pazolini, Ilya Reznik, who was declared bankrupt, the Moscow Arbitration Court ordered the debtor’s son to return the land plot donated to him by his father with an area of 1,5 ha.
The gift agreement was invalidated, because at the time of the transaction, on 30 on April 2016, Ilya Reznik had unfulfilled obligations to ATB Bank in the amount of more than 660 million rubles.
Meanwhile, Ilya Reznik, knowing about the responsibility incurred for him to pay the debt to ATB Bank, took steps to alienate his property, the arbitration noted.
As a result of the disputed transaction, property was withdrawn from the debtor's assets, which led to the creditor losing the ability to execute the court decision that entered into legal force, and, therefore, the conclusion of the disputed transaction resulted in damage to the property rights and protected interests of the creditors.
Creditors Carlo Pazolini at the October 6 meeting decided to file a lawsuit with the petition for declaring Ilya Reznik bankrupt. On November 29, the Moscow Arbitration Court declared Ilya Reznik bankrupt, the sale procedure and property for a period of six months were introduced in his regard.
